Sick Joke Part 2

An update on my previous post about Tim Fasano's candidacy. He has not filed to run for the district 11 seat. That means he is breaking the law by having a campaign website. Good work, Tim. Below is a list of canidates that have filed.

It's illegal to have a campaign website before filing? I can see it being illegal to collect money, which he's doing as well, but I'm not sure why it would be illegal just to have a site announcing your intention to run.

I don't claim to be an expert in Federal campaign finance law, but I'll give this a shot.

To have a web site presumably means that dollars were expended to create it. Generally it is not allowed to spend money on a campaign without first opening a campaign bank account and registering as a candidate with the FEC.

Think I found the answer on the FEC Site:

How do I register as a candidate for federal office?
If you are running for the U.S. House, Senate or the Presidency, you must register with the FEC once you (or persons acting on your behalf) receive contributions or make expenditures in excess of $5,000. Within 15 days of reaching that $5,000 threshold, you must file a Statement of Candidacy (FEC Form 2 [PDF]) authorizing a principal campaign committee to raise and spend funds on your behalf. Within 10 days of that filing, your principal campaign committee must submit a Statement of Organization (FEC Form 1 [PDF]). Your campaign will thereafter report its receipts and disbursements on a regular basis. Campaigns should download the Campaign Guide for Congressional Candidates [PDF] for more information on the laws that apply to them.

I doubt he's exceeded that $5000 threshold with the website and donations collected thus far. So, I don't think he's actually broken the law.
